Under new rules, some generic drug makers can no longer meet with Crestor sales in the U. S.
The Food and Drug Administration is required by law to approve generic drugs with annual sales of less than $5 million. Crestor is the only drug to win approval from the agency.
The proposed rules also require generics to be available by January 2014, although the drugmaker is required to submit its list of generic drugs by December 2014.
Under the new rules, Crestor's generic versions of Lipitor, cholesterol-lowering drug Crestor, and blood pressure-lowering drug Plavix, which has been under patent for more than 10 years, can now be authorized as generic drug sales.
The proposed rules will require the generic companies to submit the list of approved drugs by the same date. Approval can be granted if the new rules were passed a year before the generic versions were approved.
The agency's rules are similar to the one that the FDA has recently proposed. Under the new rules, the generic companies can no longer meet with the company's executives to help the drugmaker obtain approval to sell its generic versions.
Crestor, which is being developed as an anti-depressant, has faced competition from Merck & Co., a generic company that has said it plans to file U. patents for Crestor. Merck said it would begin selling the generic version of Crestor later this month.
The company said it is working to get the new rules into the Federal Register, which is posted on the company's website. The company has not yet signed on to a generic version.
In the meantime, Crestor's patent has been set to expire in 2012 and is still available in the U. for sale.
